1. PARTIES

This Equipment Rental Agreement is entered into on [Date] by and between:

2. EQUIPMENT DETAILS

The Lessor agrees to rent the following equipment to the Lessee:

3. RENTAL TERM

6. USE OF EQUIPMENT

Lessee agrees to use the equipment in a safe, lawful, and proper manner.

Only trained, authorized personnel may operate the equipment.

No modifications may be made to the equipment.

7. MAINTENANCE & DAMAGE

Lessee shall maintain the equipment in good condition.

Lessee is liable for all damages, excluding normal wear and tear.

Any issues must be reported immediately to GAINES Construction Rentals, LLC.

8. INSURANCE

Lessee shall carry insurance coverage for liability, theft, and damage for the rental term.

A certificate of insurance may be requested prior to delivery.

9. LIABILITY

GAINES Construction Rentals, LLC is not liable for any injuries, damages, or losses arising

from the use of the equipment.

10. GPS TRACKING

For the protection of both parties, GAINES Construction Rentals, LLC may install a GPS

tracking device on any rental equipment.

This device is used solely to monitor the equipment's location, prevent theft, and ensure

timely return.

By signing this agreement, the Lessee consents to such monitoring for the duration of the

rental period.

11. HOLD HARMLESS

The Lessee agrees to hold harmless, defend, and indemnify GAINES Construction Rentals,

LLC, its owners, employees, and agents

from any and all claims, liabilities, damages, losses, or expenses (including attorney’s fees)

arising out of or related to the Lessee’s use,

operation, transportation, or possession of the rented equipment. This includes, but is not

limited to, injury, property damage, or loss

resulting from negligence, misuse, or failure to comply with operating instructions or safety

guidelines.

12. TERMINATION

Lessor reserves the right to terminate this agreement and recover the equipment at any

time if terms are violated.

13. GOVERNING LAW

This agreement is governed by the laws of the State of Florida.

14. ENTIRE AGREEMENT

This document constitutes the entire agreement between the parties and may only be

amended in writing signed by both parties.
